Another key finding is that there continues to be unacceptably wide variation in operation of complaints procedures within the NHS. The NHS still has no national protocol for the classification and reporting of complaints, and reporting by Foundation Trusts remains voluntary. NHS culture is too often defensive and the service remains to be persuaded to adopt a more open culture. All providers of NHS care should in future owe a duty of candour to their commissioners under which they provide: timely reports, prepared to an agreed protocol, of all complaints made to them by NHS patients; in cases when complaints are upheld, Complaints Action Plans to address the weaknesses which have been revealed; progress reports of the actions required under the Plans. The inquiry also examined the arrangements under which the NHS handles litigation by patients, concluding that the existing clinical negligence framework (based on qualifying liability in tort) offers patients the best approach. It does not support a switch to no-fault compensation. The committee also recommends that Ministers should review the regulatory framework that governs the activities of claims management companies. |

Caller display should be a free service and the Committee regrets BT's decision to charging explicitly for caller display. Some nuisance callers withhold their numbers or hide behind a false one. Nuisance text messages can be simply reported by forwarding them to a dedicated short code number (7726) and a similar facility for nuisance calls to landlines is long overdue and would provide useful intelligence to regulators. There should be a single online complaints form. Given that many people do not have internet access, there should also be a single nuisance calls helpline. The legal threshold for the Information Commissioner to take enforcement action under the Privacy and Electronic Communications (EC Directive) Regulations 2003 must also be lowered. A single nuisance calls regulator might have superficial appeal, but a single point of contact for customers coupled with more effective coordination between regulators - behind the scenes - is both more achievable and desirable. Data collection about road accidents needs to be improved help to assist detection of fraudulent personal injury claims and help highways authorities improve road safety by targeting spending on accident black-spots. The Committee also supports the proposal for an accreditation scheme for medical practitioners who provide medical reports in relation to whiplash claims. Access to justice could also be impaired by Government proposals to switch whiplash claims between £1,000 and £5,000 to the small claims court, particularly for people who do not feel confident to represent themselves against insurers who will use legal professionals to contest claims.
