braidwood management inc. v. becerra: The Law and Ethics of Data Sharing in Health Sciences Marcelo Corrales Compagnucci, Timo Minssen, Mark Fenwick, Mateo Aboy, Kathleen Liddell, 2024-01-02 Data sharing – broadly defined as the exchange of health-related data among multiple controllers and processors – has gained increased relevance in the health sciences over recent years as the need and demand for collaboration has increased. This includes data obtained through healthcare provisions, clinical trials, observational studies, public health surveillance programs, and other data collection methods. The practice of data sharing presents several notable challenges, however. Compliance with a complex and dynamic regulatory framework is essential, with the General Data Protection Regulation being a prominent example in a European context. Recent regulatory developments related to clinical trial transparency, trade secrecy, data access, AI training data, and health data spaces further contribute to the difficulties. Simultaneously, government initiatives often encourage scientists to embrace principles of “open data” and “open innovation.” The variety of regulations in this domain has the potential to impede widespread data sharing and hinder innovation. This edited volume, therefore, compiles comparative case studies authored by leading scholars from diverse disciplines and jurisdictions. The book aims to outline the legal complexities of data sharing. By examining real-world scenarios from diverse disciplines and a global perspective, it explores the normative, policy, and ethical dilemmas that surround data sharing in the health sciences today.   braidwood management inc. v. becerra: Priceless John C. Goodman, 2024-09-24 In this long-awaited updated edition of his groundbreaking work Priceless: Curing the Healthcare Crisis, renowned healthcare economist John Goodman (father of Health Savings Accounts) analyzes America's ongoing healthcare fiasco—including, for this edition, the failed promises of Obamacare. Goodman then provides what many critics of our healthcare system neglect: solutions. And not a moment too soon. Americans are entangled in a system with perverse incentives that raise costs, reduce quality, and make care less accessible. It's not just patients that need liberation from this labyrinth of confusion—it's doctors, businessmen, and institutions as well. Read this new work and discover: why no one sees a real price for anything: no patient, no doctor, no employer, no employee; how Obamacare's perverse incentives cause insurance companies to seek to attract the healthy and avoid the sick; why having a preexisting condition is actually WORSE under Obamacare than it was before—despite rosy political promises to the contrary; why emergency-room traffic and long waits for care have actually increased under Obamacare; how Medicaid expansion spends new money insuring healthy, single adults, while doing nothing for the developmentally disabled who languish on waiting lists and children who aren't getting the pediatric care they need; how the market for medical care COULD be as efficient and consumer-friendly as the market for cell phone repair... and what it would take to make that happen; how to create centers of medical excellence, which compete to meet the needs of the chronically ill; and much, much more... Thoroughly researched, clearly written, and decidedly humane in its concern for the health of all Americans, John Goodman has written the healthcare book to read to understand today's healthcare crisis. His proposed solutions are bold, crucial, and most importantly, caring. Healthcare is complex. But this book isn't. It's clear, it's satisfying, and it's refreshingly human. If you read even one book about healthcare policy in America, this is the one to read.

Abreu, 2023-06-12 This book presents descriptions of interventions, results of empirical research, and theoretical contributions developed by Latine/x psychologists based on affirmative approaches aimed at promoting acceptance and understanding of LGBTIQ+ people. Contributions in this volume bring together the work of Latine/x scholars, practitioners, and activists across five Latin American countries or territories (Argentina, Chile, Colombia, Mexico, and Puerto Rico) and in the United States, in an effort to provide multicultural perspectives to LGBTIQ+ affirmative psychological interventions that highlight local, regional and national particularities. Chapters in this volume go beyond contributions made by applied psychology fields (e.g., clinical and counselling psychology), where affirmative orientations are predominantly located, and include contributions from other fields of psychological research such as social and community psychology. The book is divided in two parts. Chapters in the first part focus on the experiences of trans and gender non-conforming people, with emphasis on contemporary systemic issues that affect gender identity among Latine/x communities and those who do not conform to hegemonic narratives about gender. Chapters in the second part focus on sexual identity among Latine/x LGBTIQ+ people and their families and communities. Contributions in this part present discussions about sexual orientation (grouped in LG/LGB identities), sex and gender dissidence, and the inclusion of intersex. LGBTQ+ Affirmative Psychological Interventions: A Latine/x Perspective will be of interest to both researchers and practitioners in different fields of psychology – such as clinical, counselling, social, and community psychology – interested in a multicultural perspective to understand and develop LGBTQ+ affirmative actions to fight against the repathologization of individuals, groups, families and diverse communities.
braidwood management inc. v. becerra: Public Health Law and Ethics Lindsay F. Wiley, Lawrence Ogalthorpe Gostin, 2025 In this bold fourth edition, Lindsay F. Wiley builds on the foundation laid by Lawrence O. Gostin to define public health law and ethics for a new generation of leaders and scholars. Their examination of the scope and limits of governmental powers and duties to protect the public's health takes on new urgency in light of the devastation caused by the 2020 coronavirus pandemic and the stark inequities it revealed. Their insistence that social justice must be prioritized as a core value of public health ethics animates their analysis of communicable disease control strategies, chronic disease prevention programs, the opioid overdose and gun violence crises, and more. They elucidate what is at stake for the public in legal debates regarding the regulatory powers of administrative agencies, erosion of local government autonomy by state legislatures, and tensions between federal and state officials over safety-net programs. They focus particularly on the role of the courts in striking down popular laws and policies, boosting religious liberty and gun rights, and eroding protections for fundamental rights to sexual and reproductive freedom and racial and gender equality. The book creates an intellectual framework for ensuring that public health interventions are evidence-based and consistent with ethical values. Its incisive analysis of challenging trade-offs between individual rights and collective needs reveals complex answers to the essential question of what fellow community members owe each other when it comes to health--
braidwood management inc. v. becerra: Prophet of Discontent Jared A. Loggins, Andrew J. Douglas, 2021-05-15 This book is openly available in digital formats thanks to a generous grant from the Andrew W. Mellon Foundation. Many of today’s insurgent Black movements call for an end to racial capitalism. They take aim at policing and mass incarceration, the racial partitioning of workplaces and residential communities, the expropriation and underdevelopment of Black populations at home and abroad. Scholars and activists increasingly regard these practices as essential technologies of capital accumulation, evidence that capitalist societies past and present enshrine racial inequality as a matter of course. In Prophet of Discontent, Andrew J. Douglas and Jared A. Loggins invoke contemporary discourse on racial capitalism in a powerful reassessment of Martin Luther King Jr.’s thinking and legacy. Like today’s organizers, King was more than a dreamer. He knew that his call for a “radical revolution of values” was complicated by the production and circulation of value under capitalism. He knew that the movement to build the beloved community required sophisticated analyses of capitalist imperialism, state violence, and racial formations, as well as unflinching solidarity with the struggles of the Black working class. Shining new light on King’s largely implicit economic and political theories, and expanding appreciation of the Black radical tradition to which he belonged, Douglas and Loggins reconstruct, develop, and carry forward King’s strikingly prescient critique of capitalist society.

braidwood management inc. v. becerra: Wheat Landraces Nusret Zencirci, Faheem S. Baloch, Ephrem Habyarimana, Gyuhwa Chung, 2021-09-15 Landraces possess a very large genetic base in population structure and are dynamic populations of cultivated plants with historical origin, distinct identity, and without any formal crop improvement. They are often genetically diverse, locally adapted, and associated with traditional farming systems. Resistance genes to biotic and abiotic stress factors, which are especially diversified in landraces, are of great interest to plant breeders, faced with global climate challenge. In addition, gene pools made of different landraces grown in different ecological conditions can be used for wheat breeding to enhance quality; yield and other desirable agricultural parameters. An estimated 75% of the genetic diversity of crop plants was lost in the last century due to the replacement of high yielding modern varieties. There is, thus, an urgent need to preserve existing species, not only for posterity but also as a means to secure food supply for a rising world population. In this book, we provide an overview of wheat landraces with special attention to genetic diversities, conservation, and utilization.

braidwood management inc. v. becerra: At What Cost Nicholas Freudenberg, 2021 An incisive and powerful investigation of corporate impact on human and planetary well-being Freedom of choice lies at the heart of American society. Every day, individuals decide what to eat, which doctors to see, who to connect with online, and where to educate their children. Yet, many Americans don't realize that these choices are illusory at best. By the start of the 21st century, every major industrial sector in the global economy was controlled by no more than five transnational corporations, and in about a third of these sectors, a single company accounted for more than 40 percent of global sales. The available options in food, healthcare, education, transportation, and even online presence are largely constructed by corporations, whose sweeping influence have made them the public face and executive agents of 21st-century capitalism. At What Cost confronts how globalization, financial speculation, monopolies, and control of science and technology have enhanced the ability of corporations and their allies to overwhelm influences of government, family, community, and faith. As corporations manipulate demand through skillful marketing and veto the choices that undermine their bottom line, free consumer choice has all but disappeared, and with it, the personal protections guarding our collective health. At What Cost argues that the world created by 21st-century capitalism is simply not fit to solve our most serious public health problems, from climate change to opioid addiction. However, author and public health expert Nicholas Freudenberg also shows that though the road is steep, human and planetary well-being constitute a powerful mobilizing idea for a new social movement, one that will restore the power of individual voice to our democracy. With impeccably detailed research and an eye towards a better future, At What Cost arms ordinary citizens, activists, and health professionals with an understanding of how we've arrived at the precipice, and what we can do to ensure a healthier collective future.
braidwood management inc. v. becerra: Just Health Dayna Bowen Matthew, 2024-06-11 Choice Outstanding Academic Title 2023 The author of the bestselling Just Medicine reveals how racial inequality undermines public health and how we can change it With the rise of the Movement for Black Lives and the feverish calls for Medicare for All, the public spotlight on racial inequality and access to healthcare has never been brighter. The rise of COVID-19 and its disproportionate effects on people of color has especially made clear how the color of one’s skin is directly related to the quality of care (or lack thereof) a person receives, and the disastrous health outcomes Americans suffer as a result of racism and an unjust healthcare system. Timely and accessible, Just Health examines how deep structural racism embedded in the fabric of American society leads to worse health outcomes and lower life expectancy for people of color. By presenting evidence of discrimination in housing, education, employment, and the criminal justice system, Dayna Bowen Matthew shows how racial inequality pervades American society and the multitude of ways that this undermines the health of minority populations. The author provides a clear path forward for overcoming these massive barriers to health and ensuring that everyone has an equal opportunity to be healthy. She encourages health providers to take a leading role in the fight to dismantle the structural inequities their patients face. A compelling and essential read, Just Health helps us to understand how racial inequality damages the health of our minority communities and explains what we can do to fight back.

braidwood management inc. v. becerra: Current Northeast Paleoethnobotany II John P. Hart, 2008 In northeastern North America our understandings of prehistoric human-plant relationships, the subject of paleoethnobotany, continue to change as more samples are taken, examined, and compared to extant records. The results of these analyses are no longer relegated to the appendices of archaeological site reports, but constitute important contributions to our understandings of Native American lifeways in the Northeast, on their own and in combination with other lines of evidence. This volume presents current work in this vital field of inquiry. Its chapters reflect how paloethnobotany in the Northeast is changing to include the analysis not only of macrobotanical, but also microbotanical, remains and new theoretical developments in our understandings of prehistoric human-plant relationships. Collectively, the chapters in this book provide a sense of the breadth of paleoethnobotanical research being carried out in the Northeast and serve as a benchmark by which progress in the field can be measured in the decades to come.--Publisher's description.

braidwood management inc. v. becerra: Medical Decision Making Alan Schwartz, George Bergus, 2008-05-26 Decision making is a key activity, perhaps the most important activity, in the practice of healthcare. Although physicians acquire a great deal of knowledge and specialised skills during their training and through their practice, it is in the exercise of clinical judgement and its application to individual patients that the outstanding physician is distinguished. This has become even more relevant as patients become increasingly welcomed as partners in a shared decision making process. This book translates the research and theory from the science of decision making into clinically useful tools and principles that can be applied by clinicians in the field. It considers issues of patient goals, uncertainty, judgement, choice, development of new information, and family and social concerns in healthcare. It helps to demystify decision theory by emphasizing concepts and clinical cases over mathematics and computation.

Soils as a carbon pool are one of the key factors in several Sustainable Development Goals, in particular Goal 15, “Protect, restore and promote sustainable use of terrestrial ecosystems, sustainably manage forests, combat desertification and halt and reverse land degradation and halt biodiversity loss” with the SOC stock being explicitly cited in Indicator 15.3.1. This technical manual is the first attempt to gather, in a standardized format, the existing data on the impacts of the main soil management practices on SOC content in a wide array of environments, including the advantages, drawbacks and constraints. This manual presents different sustainable soil management (SSM) practices at different scales and in different contexts, supported by case studies that have been shown with quantitative data to have a positive effect on SOC stocks and successful experiences of SOC sequestration in practical field applications. Volume 4 includes 51 case studies dealing with cropland, grassland, integrated systems and farming approaches.
braidwood management inc. v. becerra: Touching a Nerve: Our Brains, Our Selves Patricia Churchland, 2013-07-22 A trailblazing philosopher’s exploration of the latest brain science—and its ethical and practical implications. What happens when we accept that everything we feel and think stems not from an immaterial spirit but from electrical and chemical activity in our brains? In this thought-provoking narrative—drawn from professional expertise as well as personal life experiences—trailblazing neurophilosopher Patricia S. Churchland grounds the philosophy of mind in the essential ingredients of biology. She reflects with humor on how she came to harmonize science and philosophy, the mind and the brain, abstract ideals and daily life. Offering lucid explanations of the neural workings that underlie identity, she reveals how the latest research into consciousness, memory, and free will can help us reexamine enduring philosophical, ethical, and spiritual questions: What shapes our personalities? How do we account for near-death experiences? How do we make decisions? And why do we feel empathy for others? Recent scientific discoveries also provide insights into a fascinating range of real-world dilemmas—for example, whether an adolescent can be held responsible for his actions and whether a patient in a coma can be considered a self. Churchland appreciates that the brain-based understanding of the mind can unnerve even our greatest thinkers. At a conference she attended, a prominent philosopher cried out, “I hate the brain; I hate the brain!” But as Churchland shows, he need not feel this way. Accepting that our brains are the basis of who we are liberates us from the shackles of superstition. It allows us to take ourselves seriously as a product of evolved mechanisms, past experiences, and social influences. And it gives us hope that we can fix some grievous conditions, and when we cannot, we can at least understand them with compassion.
braidwood management inc. v. becerra: Conflict of Interest in Medical Research, Education, and Practice Institute of Medicine, Board on Health Sciences Policy, Committee on Conflict of Interest in Medical Research, Education, and Practice, 2009-09-16 Collaborations of physicians and researchers with industry can provide valuable benefits to society, particularly in the translation of basic scientific discoveries to new therapies and products. Recent reports and news stories have, however, documented disturbing examples of relationships and practices that put at risk the integrity of medical research, the objectivity of professional education, the quality of patient care, the soundness of clinical practice guidelines, and the public's trust in medicine. Conflict of Interest in Medical Research, Education, and Practice provides a comprehensive look at conflict of interest in medicine. It offers principles to inform the design of policies to identify, limit, and manage conflicts of interest without damaging constructive collaboration with industry. It calls for both short-term actions and long-term commitments by institutions and individuals, including leaders of academic medical centers, professional societies, patient advocacy groups, government agencies, and drug, device, and pharmaceutical companies. Failure of the medical community to take convincing action on conflicts of interest invites additional legislative or regulatory measures that may be overly broad or unduly burdensome. Conflict of Interest in Medical Research, Education, and Practice makes several recommendations for strengthening conflict of interest policies and curbing relationships that create risks with little benefit. The book will serve as an invaluable resource for individuals and organizations committed to high ethical standards in all realms of medicine.

braidwood management inc. v. becerra: Sustainable Agriculture Reviews 14 Harry Ozier-Lafontaine, Magalie Lesueur-Jannoyer, 2014-09-03 Sustainable agriculture is a rapidly growing field aiming at producing food and energy in a sustainable way for humans and their children. Sustainable agriculture is a discipline that addresses current issues such as climate change, increasing food and fuel prices, poor-nation starvation, rich-nation obesity, water pollution, soil erosion, fertility loss, pest control, and biodiversity depletion. Novel, environmentally-friendly solutions are proposed based on integrated knowledge from sciences as diverse as agronomy, soil science, molecular biology, chemistry, toxicology, ecology, economy, and social sciences. Indeed, sustainable agriculture decipher mechanisms of processes that occur from the molecular level to the farming system to the global level at time scales ranging from seconds to centuries. For that, scientists use the system approach that involves studying components and interactions of a whole system to address scientific, economic and social issues. In that respect, sustainable agriculture is not a classical, narrow science. Instead of solving problems using the classical painkiller approach that treats only negative impacts, sustainable agriculture treats problem sources. Because most actual society issues are now intertwined, global, and fast-developing, sustainable agriculture will bring solutions to build a safer world.

But we have tried to solve this national crisis with policies that only made matters worse. In the name of “sending the right message,” we have maximized the spread of infectious disease, torn families apart, incarcerated millions of mostly Black and Brown people—and utterly failed to either prevent addiction or make effective treatment for it widely available. There is another way, one that is proven to work. However, it runs counter to much of the received wisdom of our criminal and medical industrial complexes. It is called harm reduction. Developed and championed by an outcast group of people who use drugs and by former users and public health geeks, harm reduction offers guidance on how to save lives and improve health. And it provides a way of understanding behavior and culture that has relevance far beyond drugs. In a spellbinding narrative rooted in an urgent call to action, Undoing Drugs tells the story of how a small group of committed people changed the world, illuminating the power of a great idea. It illustrates how hard it can be to take on widely accepted conventional wisdom—and what is necessary to overcome this resistance. It is also about how personal, direct human connection and kindness can inspire profound transformation. Ultimately, Undoing Drugs offers a path forward—revolutionizing not only the treatment of addiction, but also our treatment of behavioral and societal issues.

Weiner, Alan Schwartz, 2023 Our fascination with the topic of contextualizing care began about twenty years ago when the evidence-based medicine movement had taken hold. We noticed that although medical residents were skilled at identifying the latest studies and guidelines, their care plans often didn't seem appropriate once one considered the life challenges some of their patients were facing. We'd see, for instance, a patient with poorly controlled asthma put on a higher dose of a medication they weren't taking, rather than a cheaper generic, when the context was that they couldn't afford it. We coined the terms contextual error to describe these kinds of mistakes and contextualized care when patients' care plans are adapted to their life circumstances--
