brush with the law: Brush with the Law Robert Byrnes, Jaime Marquart, 2014-10-07 Just how tough are the country's most prestigious law schools? Most alumni would answer with stories of humiliating Socratic dialogue failures in the classroom and all-night, caffeine-fueled cram sessions. Until now, the traditional concept of the law-school experience was the one presented in Scott Turow's One-L, published in 1977, a dark description of his first year at Harvard Law School. Twenty-four years later things have definitely changed. Turow's book became the accepted primer--and warning--for aspiring law students, giving them a glimpse of what awaited: grueling nonstop study, brutally competitive classes, endless research, and unfathomable terminology. It described a draconian prison and endless work in the company of equally obsessive, desperate fellow students. Yet, sidestepping terror and intimidation, law students (and new authors) Robert Byrnes and Jaime Marquart entered highly prestigious law schools, did things their own way, earned law degrees, and were hired by a Los Angeles law firm, turning Turow's vision upside down. In their parallel narratives--two twisted, hilarious, blighted, and glorious coming-of-age stories--Byrnes and Marquart explain how they managed to graduate while spending most of their time in the pursuit of pleasure. Byrnes went to Stanford to reinvent himself--after a false start in politics he wanted to explore the life of the mind. It took him virtually no time to discover that the law was neither particularly intriguing nor particularly challenging. He could play around the clock. When Byrnes wasn't biking he was getting drunk and smoking crack. Finding himself when he discovered the right woman, Byrnes finally moved to Los Angeles during his third year and flew upstate only to take final exams. Born and raised in a small town in Texas, Marquart had never lived outside the state before arriving at Harvard. Amazed at his own good luck, he approached school with all due diligence. Disenchantment followed shortly thereafter, and Marquart learned he needn't be intimidated by his classmates and teachers. With a mysterious and bizarre companion--another student called the Kankoos--Jaime took up traveling but devoted most of his energy (and considerable money) to gambling, counting cards in casinos around the country. Irreverent, funny, and downright shocking, Brush with the Law will inspire undergraduates to bone up for the entrance exam, while outraging lawyers and the admissions officers of their beloved alma maters. Upon realizing how easy it was to get good grades, Jaime relates: I approached my second year with [one] goal . . . take classes that required the least amount of work and the least amount of attendance . . . To accomplish my . . . goal, I devised The System, a short instruction manual on the principles behind selecting and ditching law school classes. The System's goal was to screw off as much as possible, with few if any consequences. --from Brush with the Law |
brush with the law: Contractual Performance and COVID-19 Franz Schwarz, John A. Trenor, Helmut Ortner, 2021-11-25 As the COVID-19 pandemic continues to take its toll, contractual parties have frequently faced significant obstacles in performing their contractual obligations due to unexpected impediments arising from the pandemic and government measures taken in response. This indispensable book – the most comprehensive comparative examination of the impact of the COVID-19 pandemic on contractual performance – discusses the legal provisions and doctrines available to address these issues. The book examines under what circumstances COVID-19-related impediments may excuse contractual performance or lead to modification or termination of the affected contractual obligations in twelve representative civil and common law jurisdictions – the United States, England and Wales, Singapore, Brazil, Germany, France, Switzerland, Austria, Hong Kong, Costa Rica, China, and Russia. For each country, the book examines the following aspects in depth: the relevant fundamental legal principles; the various legal emergency valves available to an obligor to respond to COVID-19-related events; any remedies available to the obligee; selected examples for specific government measures related to particular types of contracts (e.g., construction, employment, lease agreements); and how the legal framework applies in typical factual scenarios. As further legal and factual developments occur, and with further jurisdictions being added, this publication will continue to be updated both online and in print. The book provides a detailed explanation under what conditions the emergency valves specific to each jurisdiction may apply. It cuts through the seeming complexity of the various legal rules and doctrines in these jurisdictions and shows that they often produce similar results in practice. The book thus opens up a wealth of insights for businesses, practitioners, and academics around the globe by providing an easily accessible analytical framework across key jurisdictions and typical factual scenarios. ‘Definitely mandatory reading for practitioners and academics alike!’ –Klaus Peter Berger, University of Cologne ‘Everyone who has had or is likely to have a brush with a COVID-19-induced legal issue would be well advised to keep this book within arm’s reach.’ – Davinder Singh, Davinder Singh Chambers LLC, Singapore ‘The “holy book” for all those lawyers whose clients become ensnared in the rising attempts to fix legal liability midst the rampant COVID-19.’ – Charles Brower, Twenty Essex, London |
brush with the law: The Laws of Human Nature Robert Greene, SUMMARY: This book is If you’ve ever wondered about human behavior, wonder no more. Every law that he presents is supported by a real-life historical account, with an insightful twist to drive the point home. As you read the book, don’t be surprised if you get the feeling that everyone you know, including yourself, is described in the book! DISCLAIMER: This is an UNOFFICIAL summary and not the original book. It is designed to record all the key points of the original book. |
brush with the law: The Heather Blazing Colm Toibin, 2012-10-30 Colm Tóibín’s “lovely, understated” novel that “proceeds with stately grace” (The Washington Post Book World) about an uncompromising judge whose principles, when brought home to his own family, are tragic. Eamon Redmond is a judge in Ireland’s high court, a completely legal creature who is just beginning to discover how painfully unconnected he is from other human beings. With effortless fluency, Colm Tóibín reconstructs the history of Eamon’s relationships—with his father, his first “girl,” his wife, and the children who barely know him—and he writes about Eamon’s affection for the Irish coast with such painterly skill that the land itself becomes a character. The result is a novel of stunning power, “seductive and absorbing” (USA Today). |

brush with the law: One L Scott Turow, 2010-08-03 One L, Scott Turow's journal of his first year at law school and a best-seller when it was first published in 1977, has gone on to become a virtual bible for prospective law students. Not only does it introduce with remarkable clarity the ideas and issues that are the stuff of legal education; it brings alive the anxiety and competiveness--with others and, even more, with oneself--that set the tone in this crucible of character building. Each September, a new crop of students enter Harvard Law School to begin an intense, often grueling, sometimes harrowing year of introduction to the law. Turow's group of One Ls are fresh, bright, ambitious, and more than a little daunting. Even more impressive are the faculty. Will the One Ls survive? Will they excel? Will they make the Law Review, the outward and visible sign of success in this ultra-conservative microcosm? With remarkable insight into both his fellows and himself, Turow leads us through the ups and downs, the small triumphs and tragedies of the year, in an absorbing and thought-provoking narrative that teaches the reader not only about law school and the law but about the human beings who make them what they are. In the new afterword for this edition of One L, the author looks back on law school from the perspective of ten years' work as a lawyer and offers some suggestions for reforming legal education. |
brush with the law: Cricket and the Law David Fraser, 2004-03-01 Cricket, law and the meaning of life ... In a readable, informed and absorbing discussion of cricket’s defining controversies – bodyline, chucking, ball-tampering, sledging, walking and the use of technology, among many others – David Fraser explores the ambiguities of law and social order in cricket. Cricket and the Law charts the interrelationship between cricket and legal theory – between the law of the game and the law of our lives – and demonstrates how cricket’s cultural conventions can escape the confines of the game to carry far broader social meanings. This engaging study will be enjoyed by lawyers, students of culture and cricket lovers everywhere. |

brush with the law: Invitation to Law & Society Kitty Calavita, 2016-04-11 Research and real-life examples that “lucidly connect some of the divisive social issues confronting us today to that thing we call ‘the law’” (Law and Politics Book Review). Law and society is a rapidly growing field that turns the conventional view of law as mythical abstraction on its head. Kitty Calavita brilliantly brings to life the ways in which law is found not only in statutes and courtrooms but in our institutions and interactions, while inviting readers into conversations that introduce the field’s dominant themes and most lively disagreements. Deftly interweaving scholarship with familiar examples, Calavita shows how scholars in the discipline are collectively engaged in a subversive exposé of law’s public mythology. While surveying prominent issues and distinctive approaches to both law as it is written and actual legal practices, as well as the law’s potential as a tool for social change, this volume provides a view of law that is more real but just as compelling as its mythic counterpart. With this second edition of Invitation to Law and Society, Calavita brings up to date what is arguably the leading introduction to this exciting, evolving field of inquiry and adds a new chapter on the growing law and cultural studies movement. “Entertaining and conversational.” —Law and Social Inquiry |
brush with the law: Brush Cat Jack McEnany, 2009-03-17 A Year in the Woods Brush Cat recounts a year in the life of men who perform one of the most dangerous jobs in America—logging New England’s vast forests for timber used in hundreds more ways than most of us realize, from houses to furniture to paper to electricity. In the spirit of John McPhee and Tracy Kidder, we meet an unforgettable cast of characters; feel their pain and exultation, and come to realize the centrality of wood in all of our lives. While they are first and foremost loggers cutting down trees, they are also ardent and effective conservationists who depend on healthy, intact forests for their long-term survival. True, some loggers are wood pirates, but most are pragmatic environmentalists, always asking the question: How do we keep this crop alive and thriving forever? The narrative moves deftly from useful tips on how not to lose body parts to a chain saw, through the terror of huge trees that fall the wrong way, to inconsistent and wrong-headed government forest management. It explores the worldwide demand for wood and wood chips, as well as the effect of climate change on the forest, and traces the money that keeps it all moving. Brush Cat clears the branches to reveal a hidden and fascinating world. |

brush with the law: The Law’s Delay Hugh Cameron, 2022-10-19 This is the light hearted tale of a fictitious orthopedic surgeon stumbling down the strange alley-ways of the intersection of medicine and the law, both of which many people find fascinating. As orthopedic surgeons look after trauma case, inevitably they become involved with ‘The Law’ as someone has to tell the judge and jury just what the injuries were and the expected long term outcome. The incidents described are entirely fictitious, as are the characters. Any distant relation to reality is purely by chance. It is modelled after Rumpole of the Old Bailey, that stalwart upholder of the golden thread of justice. The peregrination starts in Scotland, then moves to Canada with an outsider’s look at some interesting US situations. As the author has no legal training or knowledge whatsoever, none of this is to be taken seriously. The sources of the tales are wide and varied, occasionally from dim bars late at night and more frequently from thin air. As Kipling wrote, ‘This I have heard and this I have read And this was noised abroad. And this I have got from a Belgian book On the word of a dead French lord.’ |

In this noteworthy book, two noted legal writers systematically present every important idea about judicial persuasion in a fresh, entertaining way. The book covers the essentials of sound legal reasoning, including how to develop the syllogism that underlies any argument. From there the authors explain the art of brief writing, especially what to include and what to omit, so that you can induce the judge to focus closely on your arguments. Finally, they show what it takes to succeed in oral argument. |

brush with the law: History of the Yale Law School Anthony T. Kronman, 2008-10-01 The entity that became the Yale Law School started life early in the nineteenth century as a proprietary school, operated as a sideline by a couple of New Haven lawyers. The New Haven school affiliated with Yale in the 1820s, but it remained so frail that in 1845 and again in 1869 the University seriously considered closing it down. From these humble origins, the Yale Law School went on to become the most influential of American law schools. In the later nineteenth century the School instigated the multidisciplinary approach to law that has subsequently won nearly universal acceptance. In the 1930s the Yale Law School became the center of the jurisprudential movement known as legal realism, which has ever since shaped American law. In the second half of the twentieth century Yale brought the study of constitutional and international law to prominence, overcoming the emphasis on private law that had dominated American law schools. By the end of the twentieth century, Yale was widely acknowledged as the nation’s leading law school. The essays in this collection trace these notable developments. They originated as a lecture series convened to commemorate the tercentenary of Yale University. A distinguished group of scholars assembled to explore the history of the School from the earliest days down to modern times. This volume preserves the highly readable format of the original lectures, supported with full scholarly citations. Contributors to this volume are Robert W. Gordon, Laura Kalman, John H. Langbein, Gaddis Smith, and Robert Stevens, with an introduction by Anthony T. Kronman. |

brush with the law: Rogue Prosecutors Zack Smith, Charles D. Stimson, 2023-06-27 Rogue Prosecutors explains the origins, beliefs, playbook, funding, and real-life consequences of the “progressive prosecutor” movement—a group of newly elected prosecutors, their allies, and backers that refuse to prosecute crimes, hold criminals accountable, and seek justice for victims. Told through true crime stories from eight different cities, the authors explore how a radical movement funded and conceived by George Soros—and ostensibly designed to “reverse engineer” the criminal justice system as we know it—has succeeded in replacing law and order prosecutors with pro-criminal, anti-victim zealots. Weaving together extensive interviews with victims, law enforcement officers, lawyers, and judges, Rogue Prosecutors offers a searing portrait of the devastation caused by the policies of these hand-picked activists, how their hands-off approach to prosecution has encouraged lawlessness and eviscerated the relationship with law enforcement, and why minorities have suffered the most in cities with “progressive prosecutors.” In story after story, the authors underscore that justice and public safety require prosecutors to hold all criminals accountable, and that the best choice for district attorney is not necessarily based on partisan politics, but between those who believe in law and order and those who don’t. |

Balfour, 2023-03-01 The book is devoted to scholarship in the field of pre-service teacher education, with a specific focus on research into the enhancement of self-directed learning, and contributes to the discourse on creating a disposition towards self-directed learning during the social and academic integration of first-year students within higher education institutions. The target audience is scholars working in the fields of teacher education, self-directed learning, engaging pedagogies, problem-based learning, cooperative learning and gamification.
